Returns and Cancellations Policy Under Korean Law
In accordance with Korean law, consumers can generally cancel an order or return an item freely within the cancellation period (usually 7 days) of the e-commerce contract,
regardless of the contract's terms (Article 17(1) of the Act on the Consumer Protection in Electronic Commerce, etc.).
※ Any purchase contract containing provisions unfavorable to the consumer (e.g.,
prohibiting order cancellation or returns) is null and void (Article 35 of the Act).
However, you cannot cancel an order or return an item against the will of the online shopping mall operator in any of the following cases (Article 17(2) of the Act and Article
21 of the Enforcement Decree):
- If the item is lost or totally damaged due to the consumer's fault (except when packaging is damaged solely to verify the contents, in which case cancellation or return is
possible).
- If the value of the item has significantly decreased due to the consumer's use.
- If the value of the item has significantly decreased over time to the point where resale is difficult.
- If the packaging of a reproducible item is damaged.
You may cancel your order or return the item within 7 days from the date you received the written contract after ordering online (Article 17(1)1 of the Act). ※ However, if the
goods are supplied later than the receipt of the written contract, you may cancel or return them within 7 days from the date the goods are received or the supply begins (Proviso to
Article 17(1)1 of the Act).
If you did not receive a written contract, if the seller's address was missing from the received document, or if cancellation within 7 days was impossible due to reasons such
as a change in the seller's address, you may cancel or return the order within 7 days from the day you knew or could have known the seller's address (Article 17(1)2 of the Act).
If the goods differ from their display/advertisement or are performed differently from the contract, you can cancel the order or return the goods within 3 months of receiving
them, or within 30 days of the day you knew or could have known this fact (Article 17(3) of the Act).
The consumer is responsible for the costs required to return the item (Article 18(9) of the Act). ※ However, if the goods differ from the display/advertisement or the contract,
the business operator (seller) shall bear the return costs (Article 17(3) and 18(10) of the Act).
